Terms and Conditions

DEFINITIONS:

(a) The Company, hereinafter called ‘we’ means Travel Times (India) Pvt. Ltd.

(b) Tour Escort/Tour Assistant means person(s) who guide/assist the tourists on the tours/trips.

(c) Independent Contractor means any hotelier/hotel owner, airline companies, Shipping Companies, or Bus Supplier or Railway or Ferry Boat/ Cruise/ Coach Owner/ operator or any other person or organization who has been appointed by the Company to render service to the passenger(s) and who has agreed to render services to the Company.

 

SERVICES:

The Company is only a travel holiday package organizer. We do not own, operate or control any means of transport like shipping, airline, railway, buses, coaches, buses, etc. or any hotel or restaurant, other facilities or services mentioned in the brochure. And hence we cannot be responsible for any cancellations or inadequacies or inabilities to provide proper service, injury or death to persons, loss or damage to properties because of lack of co-operation from any of these independent contractors. However under such circumstances we shall extend assistance humanely possible on the spot.

The company reserves the rights to amend, alter, vary or withdraw any tour, holiday, excursion, facility or services in part or as a whole. In such cases the company shall not be responsible for the financial or personal losses to passenger(s) in any form however it may be.

 

REPRESENTATIVE:

 

The Company is empowered to designate/ appoint dedicated staff as their representative/ care taker at any place/ places at their discretion. The clients should extend all co-operations to them. Complaints if any against the representative should be brought to the notice of the management. Altercation with the representatives will be considered very seriously. Company representatives’ decisions are final and binding. Tour manager will accompany only if the group size is twenty five and above.

 

ACCOMMODATION:

 

Suitable accommodations will be provided in accordance with the amount paid which can be either the same hotel or similar hotels as per the itinerary. In case the customer prefers an upgraded room, the cost of the room shall not be borne by the company. Unused accommodation is not claimable. A room provided should be shared with/ without extra mattress (on the floor) or otherwise as specified at the time of booking. As the company takes responsibility to provide room for the night stay, any other extra charges like laundry, and food not on the tour menu, optional excursions etc. will not be borne by the company. Other than room tariff, extra charges as mentioned above if availed should be settled before the checking out time as published by the hotelier. The check-in and checkout time are as fixed by each hotel. Certain hotels will have 12 noon as the check out time and certain hotels have 24 hour check out system. In case of delayed check out even by a few hours as deviated from the scheduled departure the rent for an entire day will have to be borne by the customer. Do not keep any valuables/ money or documents in the hotel while leaving for sightseeing or outing. The company will not be responsible in case of loss or theft of the same. 

 

TRANSPORT:

The type and size of the vehicle provided will be determined by the confirmed group size. We reserve the right to allocate the most suitable vehicle for the group based on capacity and availability. While we strive to accommodate all group sizes comfortably, any requests for specific vehicle types must be communicated during the booking process and are subject to availability and cost. Any changes resulting in an increase in group size may incur additional charges. Additional Charges will be levied on customer if Pickup/Drop from Airport/Railway Station is not mentioned in the itinerary.

 

COST HIKE:

The company reserves the right to revise the fare/tariff with/without notice when hike of fuel cost/ tax or ay other such events occur. The customer is liable to absorb the additional cost and co-operate. Any such increase in price should be paid by the customer in full before the commencement of the tour. In certain exceptional cases where there is a hike in price during the tour, the amount must be paid in full by the customer during the tour. Tour dates & tour programs as well as number of days published in the website/ brochures are subject to change.

 

EXTRA PAYMENTS:

Service tax/ charges, airport taxes, entry fees, entertainment expenses such as boating, horse riding, trekking or any other activities, hot and cold beverages food during train journey and on road journey, medical evacuation expenses and anything / expense not specified in the itinerary and schedule should be borne by the client unless specified clearly. If the company is compelled to bear any or all the expenses mentioned in the para, then, the company has the rights to recover the amount as they feel fit.

 

FOOD:

The company generally has a policy to provide Vegetarian food to the passengers on conducted group tours if the number of passengers per tour is or above twenty five. In case the numbers of passengers happen to fall below twenty five, food will not be provided by the company but alternate arrangements for providing food will be made OR refund will be given for the food portion as per the company’s norms. And for fixed departures, MAP meal plan would be applicable.

 

FRESH UP FACILITY:

While after a night journey, the tour escort shall arrange fresh up facilities as per the availability and road conditions. For lack of way side amenities and facilities company shall not be responsible in any way.

 

BOOKING:

The booking form should accompany with an advance of 25% of the fare with train/flight/ship ticket amount. Balance should be paid at least 30 days before commencement of services. The bookings will be processed only after the amount due towards the package is received in full. If the customer fails to make the payment as per the instructions then the company reserves the right to cancel the reservation. In case of dishonored cheque the passenger will have to pay Rs.500/- for every such dishonor. A cheque dishonored is an offence under the Negotiable Instruments Act, 1881 and the company reserves the right to take necessary legal action as may be advised. 

 

INSURANCE:

The tourist is advised to insure himself and belongings directly. Under circumstances where the client seeks compensation for any eventuality the company will not be held responsible in any manner. For Kailash Manasarovar yatra and other high altitude tours, the age limit is 69 years and all the passengers will have to compulsorily submit the medical certificate as a proof of fitness. Medically unfit or sick passengers who wish to undertake any tour should be compulsorily accompanied by a co passenger for the entire tour.

 

CANCELLATION AND REFUND:

 

If the customers intend to cancel the tour due to any reason, the same shall be intimated to the company in writing or in person within the time limit along with the receipt issued by the company. The cancellation will be made after retention of cancellation charges by the company as mentioned below.

 

(i) Flight / Ship / Train ticket                           as per their regulations

 

(ii) For holiday plans / excursions /

    Tour packages                                            (a) with more than one month prior notice-           as and when the hotelier returns the money and after deduction of taxes and other expenses.

                                                                        (b) Between 29 and 15 days- 25% of the total tour amount will be retained by the company

                                                                        (c) Between 14 and 7 days- 50% of the total tour price will be retained by the company.

                                                                        (d) And within 6 days no refund will be allowed.

(iii) For Room rent                                          as per the rules of the hotelier as and when received by us.

                                                                       

The company reserves the right to cancel a tour prior to its departure with/without assigning any reason. The refund will be made only on producing the receipt issued by the company.  No compensation and/or interest will be paid in any case.

 

The tours may be advanced or postponed due to various reasons and the customers are bound to co-operate with the same. In case the customers intend to cancel the tour due to such changes the tour amount shall be refunded after holding back a minimum of  Rs.2,500/- in case of domestic tours and Rs.10,000/- in case of international tours as processing fees.

 

 Refund of any nature will be made strictly through an A/c payee cheque and on production of the receipt issued by the company.

 

LIABILITY AND RESPONSIBILITY:

 

Though the customer can give a preference of berth for booking train tickets pertaining to a tour, the company cannot be held liable in case the railway department does not provide the ticket as per the preference of the customer. The company will not be responsible for allocation of seats in any means of transport.

 

The company will not be responsible for loss of baggage, food service in the aircraft/train, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any damage to baggage or personal effects howsoever caused.

 

In case of death or missing passengers while on tour applicable rules and all the procedures pertaining to the death will have to be followed by the guest’s relatives themselves. Where a tourist is traveling alone, in case of his death or on his getting missed en route the tour, the company shall undertake to make arrangements for following the procedures regarding the same provided the nearest kith and kin of the concerned passenger undertake and guarantee to reimburse the expenses incurred for such arrangements.

 

JURISDICTION:

 

For all disputes and claims the legal jurisdiction should be Chennai.
